Licensing questions

What does Royalty Free mean? Royalty free music is music that one can purchase the rights to use in one's production at an affordable price.
Royalty free music means the music can be used royalty free, but only within a specified set of uses. For example, your music license may allow use on all radio broadcasts with no royalties due, but does require royalties for broadcast on TV.
You may produce and sell a product that contains music from the Filmtvtracks production library without any additional licensing fees providing the end user of your product is restricted from obtaining direct access to the music for personal use.
TV stations and radios pay royalties to the Performance Rights Societies for the right to broadcast music. Music usage on TV broadcasts are tracked by a listing known as a Cue Sheet.
The broadcasters still pay their royalties to the performance rights societies ( Ascap, Bmi, Socan, Sacem…), most royalty free music libraries require cue sheets and must be submitted when the music is to be broadcast on TV.

What is Copyright?
Copyright is defined as the exclusive right of a creator ( ie: the composer , publisher ) to reproduce, prepare derivative works, distribute, perform, display, sell, lend or rent their creations.
A simple definition of Copyright is the "right to copy, publish or perform". Filmtvtracks is the registered copyright owner of its music products.

What are Performing Rights?
Broadcast of Filmtvtracks music is cleared through the performing rights society BMI or ASCAP, whose revenues are collected directly from broadcast station licensing, not from you as a producer. This public performance revenue is divided among the composers and publishers based on "reported use", which is usually submitted via a Cue Sheet.


What is Synchronization?
Synchronization is the term that describes the way in which Filmtvtracks music can be utilized in productions that you create. A sound can be synchronized with a visual presentation or with other audio material such as a voice over - as in the case of a radio commercial. A music track can be synchronized for use in many media: television, radio, film, multimedia and audio-visual presentations, Web sites, computer games and music. Our license includes the synchronization rights required to allow you to use the music in your productions. The rights to re-sell, re-publish or otherwise distribute Filmtvtracks music are not obtained with your acquisition of synchronization rights to our products. Our music tracks must be synchronized within a multimedia presentation, film, Web site, game, audio-visual production or broadcast to complete your commercial or non-commercial production without any additional licensing fees.

What is a cue sheet?
A music cue sheet is a document that lists all of the music contained in a production including the title, composer(s), publisher(s), performing rights affiliation, and use and timing of each musical cue.
The cue sheet functions like an invoice that is used by all parties in the music licensing process to determine the amount of royalties to be paid for the public performance of the music contained in the program, and to whom those royalties are paid. For example, many broadcasters require copies of cue sheets for the television programs they broadcast in order to calculate the fees they must pay to ASCAP and BMI. Without the timely receipt of music cue sheets, they may not have access to the information necessary to correctly calculate the full amount of the license fee that would otherwise be due -- resulting in a loss of income to composers and music publishers. Moreover, ASCAP and BMI use a cue sheet to identify the composers and publishers entitled to receive royalties and to calculate the share of royalties they receive. The flow of music publishing royalties should be of vital concern to the producer if musical cues composed for the production are owned by the producer.
Cue sheets are submitted by the production company to the broadcast company and are filed with the applicable Performing Rights Society (BMI, ASCAP, SESAC, SOCAN, SACEM etc).

When and how should I submit a Cue Sheet to a Performing Rights society?

If you are including tracks from our library in your film or video, and you plan to broadcast your production on television (Network, Cable, Public) a cue sheet must be filed and submitted to the broadcasting company with your production.

Can I use the music in a mass produced and marketed product?
Our standard music license allows you to manufacture and distribute up to 3.000 units without any additional licensing fee. If you expect to produce more than that, a very affordable mass production license can be obtained by calling our customer service representative.

Can I use the music in advertising or promos ?

"Is there any additional fee needed by me for the music rights other than the initial purchase?" Just like all royalty free music libraries, The Filmtv-tracks license allows you to use the music you purchase without any further fees to us. You, as producer, are not required to pay ASCAP fees. Broadcasters already pay these fees. you just need to submit your Cue Sheets if you are using our music for Broadcast use : TV, Radio, Film, or Theatrical productions.

What is a needle drop?
This refers to the use of a single portion, or “cue,“ of an existing recording (placing the needle down on the recording and then lifting it), in synchronization with filmed or taped images. If a needle drop or “cue“ from a produced recording has been used, one must deal with all of the normal clearance requirements with respect to the recording.
Today many clients are now choosing a less expensive “pay as you play” option, wherein they only pay for music when and as it is used. This licensing option was originally known as "needle drop" - referring to the act of lowering a phonograph needle on to a record to place the music in a production. Today, it is more commonly known as “laser drop” - referring to the play of compact discs instead of vinyl records.

Can I add vocals, lyrics, or other instruments to your music tracks and release it on CD? No, under the Standard License Agreement, adding your own vocals, lyrics or other instrumentation to our existing tracks to create your own song for CD release is strictly prohibited. If you are interested in using our music for the purposes of creating your own song, contact us for a separate license.
